UPDATE: Could Cell Phone Unlocking be Legal Again in the US?

Just when everyone thought it was now illegal to unlock cell phones (for purchased phones after January 26, 2013), President Obama spoke on March 4, 2013 saying that he will push to reverse the new law (for users that are not currently in a contract). It seems a petition of over 100,000 made it to the Whitehouse protesting the ban.

What does the petition state?

Basically it states that consumers should be able to unlock cell phones (and tablets) they own, without risking penalties or criminal persecution. And if the device is no longer under a service contract, people should be free to move to other carriers. Seems reasonable enough.

Per our original post Is Jailbreaking Legal the law was passed back in October 2012, effective in January 2013 in the United States. The Library of Congress had a 90 day window in the bill for those already with a cell phone that they would be able to unlock them within that time period.

While Jailbreaking might sound criminal, it has been legal (in the U.S.) since the year 2010 when an exemption was made to the DMCA (Digital Millennium Copyright Act) law allowing users to jailbreak their iOS devices and subsequently use applications which were not provided by Apple.

This made Jailbreaking Apple’s smart phones legal in the United States. Apple now has a policy that states that Jailbreaking any mobile device of theirs will void the warranty.

Effective January 26, 2013 the DMCA rules were revised and renewed after a period of three years. In October 2012, the Copyright Office still approved exemptions to the DMCA rules which allowed iPhone users to jailbreak their devices and continue using Apps which were not approved or provided by the Apple App Store.

However, this exemption is not available for tablet computers and in this case the iPad. It should therefore be noted that while it is legal to remove the software limitations on an iPhone and iPod, it is illegal to do so with an iPad – for devices purchased after 1/23/13.

The Electronic Frontier foundation which advocates for digital rights was hoping that an exemption would be made to the DMCA to allow Jailbreaking on Tablet computers but hope of such freedom has wait until the DMCA rules are renewed again in another three years (2015).

Even though tablet sales are increasing at an enormous pace, they are not as popular as smart phones. The Electronic Frontier foundation hopes that an exemption will be made in the next three years to allow Jailbreaking on the iPad again, at which time the tablets will be as common and popular.

Jailbreaking vs. Unlocking – Not the Same

It should be noted that Jailbreaking is not the same thing as unlocking. While Jailbreaking involves getting rid of software restrictions, unlocking involves the removal of SIM restrictions and hence making it possible to use your device on different carriers (like Verizon, AT&T, etc.). How to Jailbreak an iPod Touch

How to Jailbreak your iPod

In general though, these are the basic steps:

  1. Check that you have the most current version of iTunes on your computer (General, settings, about in most versions), install any if needed.
  2. Sync your iPod with iTunes as a backup (and also backup your iTunes once this is done).
  3. At this point we recommend you get help from a service provider. However, there are DIY options if you’re comfortable with that.

  4. Download the recommended jailbreak software compatible to Windows or the Mac and save it in a folder, per the instructions (review companies here).
  5. Unzip the file by double clicking on the folder to extract the application and launch it on your iPod.
  6. Click on the Jailbreak button after launching the application by running it as Administrator.
  7. A prompt will appear to connect your iOS iPod Touch to the computer and switch the iPod off.
  8. Following the instructions on your computer Click the Next button to go to the next screen.
  9. Set the iPod touch to DFU mode.
  10. Hold the Home button after turning on the iPod until the software detects the device.
  11. Release the Home button as your iPod starts rebooting.
  12. You will be prompted to select an option (i.e. Cydia). Then go to Next to reboot the device and the software will upload the kernel and RAM disk.
  13. You can exit from the software application on your computer after completing the process on your iPod.
  14. Reboot the iPod again and now you should be able to upload apps of your choice to your device.
